Legal roles and compliance

For the purposes of the General Data Protection Law (Law No. 13,709/18 – LGPD), CHECKBITS clarifies that it acts predominantly as a DATA PROCESSOR (Operadora).

In addition to compliance with the General Data Protection Law (Law No. 13,709/18), CHECKBITS observes international data protection best practices, seeking alignment, whenever applicable, with the principles of the GDPR (General Data Protection Regulation).

What this means

Decisions regarding the processing of information entered into checklists and digital forms belong exclusively to our clients and corporate users, who hold the status of DATA CONTROLLERS (Controladores). CHECKBITS shall perform the processing of such data strictly according to the instructions provided by the Controller and for the purposes of contractual execution.

Data we collect and why

To access our content, subscribe to our newsletters, and receive special promotional offers, we collect your first name, your WhatsApp-registered phone number, and your best email address, based on your consent. From the emails sent, we also collect data regarding your engagement history, such as whether you received the email, opened it, or clicked on any provided link.

This collection is based on our legitimate interest to understand your preferences and improve our services. Rest assured, our access to this type of information is strictly limited to the emails sent by us, with no possibility of accessing any other emails you receive.

We collect your email and phone number so that we can deliver the requested services or information related to the content you seek. Your email and phone number serve as our primary communication channels with you. Regarding the collection of your name, it is processed to personalize our contact and ensure we remain directly connected with you. We also collect this data so that you may join our contact list.

Our contact list (and how to leave it)

What does this mean?

It means that we will send you emails and messages regarding topics related to the services you requested, as well as informative and promotional content to keep you updated on everything we produce.

However, if you no longer wish to be part of our contact list, that is not a problem! Each email you receive will include, at its end, a link that can be used to remove your email from our list. This link can be used whenever you no longer wish to receive our emails.

If you no longer wish to receive messages on your WhatsApp, simply send us a message stating that you no longer wish to receive them. Our team will promptly remove your contact from our broadcast lists.

The collection of actions performed following receipt of our communications aims to support and promote our activities, with the goal of understanding your preferences regarding the content and services provided. This allows us to improve our applications and consistently deliver the best experience to you, based on our legitimate interest.

Our focus is to provide you with the most transparent experience; therefore, we always guarantee, across all our communication channels, the option to opt out and withdraw from our contact list.

Data sharing

We share personal data information with our page and email processors — specifically RD Station and Leadlovers — for the purpose of enabling contact with our users through access pages and email.

Without such sharing, it is not possible to deliver the desired content to you. This sharing only occurs after you complete your registration, strictly adhering to the principles of purpose, necessity, adequacy, and transparency. RD Station and Leadlovers store your registration information (name, phone number, and email), as well as your interaction history, to facilitate our communication channel and the continuous improvement of our services.

Legal partners. Should you purchase one of our plans, your data will also be shared with and collected by Freitas e Freitas Sociedade de Advogados, the law firm responsible for formalizing our relationship. Such sharing occurs specifically for the execution of the contract established between you and our company.

Strategic partnerships (Fusion Tecnologia). We may share users' personal information with FUSION TECNOLOGIA and other organizations or individuals outside of CHECKBITS, when we have your free consent or to ensure the continuity of specialized technical support and integrated solutions offered by CHECKBITS. This sharing always respects the principles of purpose and necessity established by the LGPD.

We may also share information if we believe, in good faith, that access, use, preservation, or disclosure of the information is necessary to:

I. Comply with any applicable legislation, regulation, court order, or governmental request;
II. Comply with applicable Terms of Service, including the investigation of potential violations;
III. Detect, prevent, or otherwise address fraud, technical, or security issues;
IV. Protect against harm to the rights, property, or safety of our users or the public, as requested or permitted by law.

Data retention periods

We will maintain your personal data only for as long as necessary to fulfill the purposes described in this policy.

Marketing data

Information collected for marketing purposes will be retained until you request its deletion (opt-out).

Contractual data

Data related to the execution of contracts will be preserved for up to 5 (five) years after the termination of the business relationship, for the purposes of complying with legal obligations or the regular exercise of rights in potential legal proceedings.

Cookies and tracking pixels

We have pixels from Google, Facebook, and LinkedIn installed on our page. These pixels are used for advertising purposes, as we require such advertisements for the company's legitimate interest. We clarify that we do not know to whom each specific advertisement is directed, as the pixel does not identify the individual directly; the companies Google, Facebook, and LinkedIn perform the targeting.
